CHATTANOOGA, Tenn., Monday, Aug. 18, 2025 — Chancery court judge Jeff Atherton avoids my case to end fraud under color of Tennessee financial responsibility law, unwilling to be empowered by a righteous cause, refusing without recusing.
My suit filed in Hamilton a chancery court prompted an immediate recusal order by Judge Pamela Fleenor. The judge presiding judge over the district, Boyd Patterson in the criminal court, issues an order saying that judge J.B. Bennett in circuit court will oversee the case.
David Jonathan Tulis v. Department of Revenue rises from a contested case in that department, fought nearly two years, over revocation of the tag of my 2000 Honda Odyssey minivan.
The revocation of the registration reduces the minivan back to a mere automobile when it it been registered with the department for use in commerce. It being revoked means that the latitudinarian constabulatory that coerces even private users of the road into commerce may attempt my arrest at any time. I use the minivan outside of any activity touched by privilege law upon privilege taxable activity, and am specifically targeted by officers for this alleged offense in use of my private property or private chattel.
Judge Atherton is a chancellor in chancery court. I ask myself, why is he not accepting my case, filed not in circuit, where Judge Bennett works, but in high and hallowed chancery?
Judge Fleenor gives no grounds for recusal. Judge Atherton has effectively recused without issuing an order into the record. I had hoped he would take the case, when indications from November 2024 were that he would not. I had filed my lawsuit against safety Cmsr. Jeff Long and revenue Cmsr. David Gerregano, seeking access to the three-judge panel, in Hamilton County chancery. Judge Atherton recused, then, too, without stating grounds.
Judge Bennett, before taking office in 2014, worked at Spears Rebman law firm.
