CHATTANOOGA, Tenn., Friday, May 1, 2025 —  A radio journalist suing two state commissioners is asking a judge for permission to go over her head to challenge her refusal to stop a program that generates 40,832 criminal arrests a year.

David Tulis is suing to halt what he calls the “Eye of Sauron” program run by department of revenue Cmsr. David Gerregano. The case is in Davidson County chancery court where chancellor Anne Martin refused April 29 to decertify use of EIVS, the electronic insurance verification system. 

“The relief sought is broad and sweeping,” Judge Martin said in her order. “It would have a major impact on some significant programs administered by the state.” 

The surveillance tower seeks out 12,000 auto insurance noncustomers every week for inquiry and tag suspension in a program targeting motor vehicle registrants alleged by state officials to be subject to the Tennessee financial responsibility law of 1977. More than a million of 6 million vehicle owners are not customers of State Farm, Grange and other members of the Tennessee Automobile Insurance Plan.

“The program of these corporate bagmen has created 68,000 convictions among innocent people since I began suit July 26, 2023,” Tulis says, “mostly among the poor. They opt to pay for food, rent, health care, car repair, tuition, childcare and other necessities. They’re the ones you see left on the side of the road as the cop orders their car towed away for no insurance, and then they hafta pay the tow truck operator $150 or $200 ransom, with $45 daily storage fee if they can’t come up immediately with the cash.”

Tulis’ suit also names Jeff Long, commissioner of safety, whose troopers use section 139 of the law as basis for the mandatory insurance policy.

“Cmsrs. Long and Gerregano in their attack on me and the rest of us constitute an unrelenting public calamity. They refuse to obey our good Tennessee law. They’re hard as stone in their wickedness and cruelty. They are secure in self-contradiction, and I’ve caught them,” Tulis said.

Tulis of Eagle Radio Network, an FM rock hits station, says the only person subject to the financial responsibility law is one who’s had a qualifying accident or whose license has been suspended for an unsatisfied court judgment or criminal conviction. That person has to buy a high-risk “motor vehicle liability policy,” under the SR-22 certificate.  ###
