First job of new U.S. magistrate Dumitru: Handle warrantless arrest reform case

CHATTANOOGA, Tenn., Thursday, Jan. 8, 2025 — The case Tulis v. Bennett seeking to slash arrest levels up to 60 percent in Hamilton County by a court order is in the hands of a newly assigned federal magistrate.

Circuit Court Judge Michael Dumitru was sworn in Jan. 1 at a ceremony in the Joel Solomon federal building downtown. The lawsuit targets abusive warrantless arrest practices by Hamilton County sheriff’s office and improper criminalization of administrative wrongs by licensees of the Tennessee department of safety.

I just filed request for entry of default in the case because Hamilton County is refusing to respond to the complaint.

Judge Dumitru had been a circuit court judge since September 2022. Before that he worked as attorney at Miller & Martin law firm. At an event, U.S. district court judge Travis McDonough appointed him to an eight-year term. Magistrates handle many cases and are usually assigned cases before they go to trial.

Other magistrate judges in Tennessee’s eastern federal court district are Christopher H. Steger in Chattanooga, Debra C. Poplin and Jill E. McCook in Knoxville and Cynthia R. Wyrick in Greeneville.
